Agreement to Terms

By downloading, installing, or using YourFunCards ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and YourFunCards ("we," "our," or "us").

Use of the App

License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App for any illegal or unauthorized purpose
• Share your subscription or purchases with others
• Attempt to bypass payment systems or access premium content without authorization
• Use automated systems or bots to interact with the App

Age Requirements

You must be at least 13 years old to use this App. Some collections contain adult content and are marked as premium. By accessing these collections, you confirm you are at least 18 years old.

Purchases and Subscriptions

Payment

The App offers both one-time purchases and auto-renewing subscriptions. All purchases are processed through the Apple App Store and are subject to Apple's payment terms.

Subscriptions

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your App Store account settings.

• Subscriptions unlock all premium collections for the duration of your subscription
• Payment is charged to your Apple ID account at confirmation of purchase
• Your subscription will automatically renew at the same price
• Cancellation takes effect at the end of the current billing period

Individual Collection Purchases

You may purchase individual premium collections as a one-time payment. These purchases are permanent and do not expire.

Refunds

All purchases are final. Refund requests must be made through the Apple App Store in accordance with Apple's refund policy. We do not have the ability to process refunds directly.

Price Changes

We reserve the right to change subscription and purchase prices at any time. Price changes will not affect existing subscriptions during their current billing period.

Content

Our Content

All card questions, collections, graphics, text, and other content in the App are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Content Disclaimer

The App is designed for entertainment purposes. Some questions may touch on sensitive topics. We strive to create fun, engaging content but make no guarantees about the suitability of any particular question for your situation.

Premium collections may contain adult themes, suggestive content, or mature topics. These are clearly marked, and access requires age verification.

User Discretion

You are responsible for:

• Choosing appropriate collections for your group
• Deciding whether to answer or skip any question
• Maintaining a respectful and safe environment when playing
• Ensuring all players are comfortable with the chosen collection

Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Important: We never collect, store, or see your answers to card questions. What happens in your game stays in your game.

Disclaimers and Limitations of Liability

As-Is Basis

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Guarantees

We do not guarantee that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected
• The App will meet your specific requirements

Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code transmitted through the App
• Any content or interactions that occur during gameplay

Indemnification

You agree to indemnify, defend, and hold harmless YourFunCards, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any interactions or incidents that occur during gameplay

Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice, for any reason including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the App or our systems
• At our sole discretion

Upon termination, your right to use the App will immediately cease. Termination does not entitle you to a refund of any purchases or subscriptions.

Changes to the App and Terms

We reserve the right to:

• Modify or discontinue the App or any features at any time
• Update these Terms at any time
• Add, remove, or modify card collections and content
• Change pricing for new purchases and subscriptions

Changes to these Terms will be posted with an updated "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and YourFunCards regarding the use of the App and supersede all prior agreements and understandings.
